Mangalore : A P Gowrishankar, Legal Advisor of Mulageni Okkalu Rakshana Vedike said government could form rules, since the High Court had not granted stay to the implementation of the Act.
Speaking at the fourth annual general body meeting of Mulageni Okkalu Rakshana Vedike, held at October 12 he said that landlords filed a writ petition in the Court questioning the relevancy of the Act after the government passed it.
He said that court posted the judgement to March, 2014 after hearing both the parties. But even after several months of the specified date, the Court has not issued an order in this regard.
It is learnt that, Mulageni Okkalu Rakshana Vedike has been fighting to abolish Mulageni tenancy system in the twin districts, to form the rules and implement the Conferment of Ownership on Mulageni or Volamulageni Tenants Act 2011.
Gowrishankar, urged the government to conduct an open discussion on the act, to make necessary amendments, form rules and appoint a special officer to implement the Act without delay. Although the government passed the Act before three years tenants are still waiting in limbo and not able to enjoy the land rights, he said.
Jospeh Martis, Vice President of Vedike said that there are around 11,000 cases pending pertaining to Mulageni issue in various courts and several tenants are living in fear of being evicted from the landlords.
According to the system, Mulageni tenants have the rights to enjoy the property which they possess but have no right to sell, mortgage or transfer it at own wish.
