Chikkamagaluru : Karnataka Komu Souharda Vedike State General Secretary K L Ashok said that the State government will be requested to file a review petition before the High Court, regarding the clarification of directions given by the Court.
Addressing mediapersons in Chikkamagaluru on Wednesday, he said that the Central Act 1991 states that the condition of religious centres prior to 1947 should not be considered.
“But, the High Court has ordered to look into the condition of Bababudangiri Dargah before 200 years and to appoint priests if the establishment is a temple. Though the Supreme Court has imposed a stay on the above said judgment in 2008, it had ordered to conduct a public inquiry and to submit a report,” he added.
“The confusion on the validity of the report by Endowment Commissioner – based on 1991 Act – persists. Hence, a memorandum will be submitted to the Law minister on Thursday to submit a review petition to the court, to clarify its directions,” he said.
Ashok further said that the recommendations by the Endowment Commissioner, saying the mode of worship should be in Agama tradition, are not acceptable because, as per the 1991 Act, the government will be treated as the wrongdoer, which may further lead to legislative conflicts.
“If at all the state cabinet has to take the decision, there should be no delay,” K L Ashok said and urged the State government to call a special Cabinet meet to solve the Datta Peetha issue within a month.
Vedike State Secretary Gouse Mohiyuddin said that the district administration should not give permission to carry out the new practice, during the Datta Jayanthi this year.
