Bangalore: A CBI Probe ordered by a single judge into Mangalore advocate Noushad Kashimji murder was reversed by Karnataka High Court, as under an Act of 1946, govt. consent was necessary for such a probe, as argued by additional advocate general K.M. Nataraj on the issue.
The he bench had CJ, V. Sen and Justice B.V.Nagaratna. Justice Mohan Shantanagouder’s verdict was upset, as of 14-07-2011, where Nusrat Jehan (wife of the deceased) had made the appeal.
The state in a counter-appeal to KHC, contended that Mangalore police had already completed the investigation and a relevant charge-sheet was duly filed. The police cannot be demoralised, the state argued.

Kashimji was gunned down in Falnir, atdusk on 9-4-2009. The police arrested 12 persons and sized 3 revolvers and cash of Rs 3.5 lakes. Purushottam Poojary, a senior counsel filed a case against 4 police officers responsible for Kashmiji murder. It was proved false.
