Bangalore: The Mangalore Bar Association had field two(2) petitions in state High court, seeking a probe by CBI into the ‘Missing’ case, and then ‘suspected murder’ of an advocate, Preetham Kumar, locally based.
But on Tuesday ,the high bench of Chief Justice Vikramjit sen and B.V. Nagaratna has rejected the plea , on the basis that when a ‘B’ report is filed by CBI in the case before the lower court of jurisdiction , it was “not proper” for the state HC to proceed in the matter.
The Bench added that the district court could reach “its own conclusions” based on evidence and nature of enquiry conducted in that case.
Additional Advocate-general K.M Nataraj submitted that Mangalore advocate Preetham’s body was taken out of sea and the ‘B’ report was filed on DNA findings on post-mortem. The case of a murder was “ruled out” by filing ‘B’ report, he added parents of Preetham refused to recognise the body as their son’s never the less.
