Mangaluru : The Additional District and Sessions Judge, Fast Track Sessions Court-1, (POCSO), Savithri V Bhat on Wednesday sentenced a 45-year-old driver to 15 years of Rigorous Imprisonment (RI) under section 6 of the POCSO Act, and imposed a fine of Rs 1 lakh under this section.
Special Public Prosecutor Venkataramana Swamy said that the court found PJ Jacob, alias Chakocha, guilty of wrongful restraint, rape and criminal intimidation. He is accused of raping a 17-year-old survivor in 2015.
In February 2015, when the survivor was returning home from school and reached near his house, he stopped her and took her into his house and raped her. He also threatened to kill her, in case she informed anyone about the incident. Subsequently, he raped her at a rubber plantation and the incident came to light when the survivor was pregnant, he said.
The court sentenced Jacob to six years RI and imposed a fine of Rs 1 lakh under IPC section 376 (rape). Further, he was fined Rs 500, under IPC section 341 (wrongful restraint) and under IPC 506 (criminal intimidation) he was convicted to six months of RI and a fine of 5,000.
Further, under the SC/ST Act, he has been sentenced to two years RI and a fine of Rs 50,000. Of the total fine amount collected as a fine, Rs 2 lakh will go to the survivor as compensation. The court directed the state to provide Rs 1 lakh compensation to the survivor.
