Bengaluru : In a significant verdict, the Karnataka High Court on Monday ruled that a wife who earns more than her husband is not entitled to receive interim maintenance or alimony. While hearing a petition filed by a man challenging a lower court’s order that directed him to pay maintenance despite his estranged wife drawing a higher salary, the High Court observed that trial courts cannot hastily order maintenance when the wife’s income surpasses that of her husband.
The single-judge bench of Justice Dr. Chillakur Sumalatha set aside the lower court’s order, stating that a husband cannot be held liable to provide financial support when his own monthly earnings are lower than his spouse’s. The case involved a couple who married in 2024 but separated within a few months. The court took into account the financial profiles of both parties, noting that the husband earned a monthly salary of 60,646, whereas the wife commanded a monthly income of 1 lakh. Furthermore, the court highlighted that the wife had no children or other major financial liabilities to look after.
The High Court advised trial courts against leaning towards granting alimony solely based on the traditional notion that a husband must financially support his wife under any circumstance. The bench explicitly stated that if a wife is financially independent, earns more than her husband, and has no additional dependents or responsibilities like childcare, courts should not pass maintenance orders based on the mere assumption that a husband is obligated to maintain his wife regardless of her financial status.
